General Business Terms and Conditions
The General Business Terms and Conditions (hereinafter referred to the “Terms and Conditions”) of the legal entity Nix Terra, s.r.o., with the registered office at: Špindlerův Mlýn 127, 543 51, ID No.: 04362314, (hereinafter referred to the “Provider”), regulate the mutual contractual relationship between the Provider and the natural person ordering the service called Yoga & Hike (hereinafter referred to the “Client”).

I. Stay booking, contractual relationship establishment
The Client orders the services by the registration form filling in on the website www.yogaandhike.cz and the advance invoice paying. The advance invoice will be issued to the Client immediately upon the registration form filling in. The booking will be completed upon the advance invoice paying.
Essential booking details: name and surname, date of birth, address of residence, contact details (telephone no., e-mail), nationality if the stay is booked for a foreign national.
The booking confirmation by the service Provider creates a contractual relationship between the Client and the Provider (hereinafter referred to the “Contract”). The subject-matter of the Contract is the obligation to provide the Client with the stay and to secure the agreed upon services in the agreed upon scope and quality (hereinafter referred to the “Stay”) and the Client's obligation to pay the agreed upon price.
By the registration form completing and submitting the Client confirms that he/she has read the Terms and Conditions and agrees with them. These Terms and Conditions form an integral part of the concluded Contract.

II. Client's rights and obligations
The Client has the right to:
be fully informed about the booked stay, i.e. its scope, date and price;
duly provision of the stay booked, confirmed and paid by him/her;
cancel the confirmed booking at any time prior to the stay commencement, in accordance with the Cancellation Terms and Conditions and the Terms and Conditions.

The Client is obliged to:
fully and correctly state all essential details of the booking;
pay the agreed upon price within the required deadline;
compensate any damage caused by the Client to the Provider or other service providers in the scope of the use of the service.

III. Obligations towards the Client
The service Provider is obliged to:
provide the Client with all information about the stay;
secure the Client's Stay according to the concluded Contract;
in case of withdrawal from the concluded Contract by the Client, to pay the difference between the already  paid price for the Stay and the relevant cancellation fees within 14 days from a written cancellation receiving.

IV. Prices of Services and their payment
The prices of Services are available at www.yogaandhike.cz.
Upon the registration form filling in, the Client is obliged to pay an advance payment amounting to 50% of the total price of the Stay. The advance invoice will be issued to the Client immediately, together with the registration confirmation, and must be paid within 7 days from the advance invoice issue date the latest, however no later than two months before the scheduled start of the Stay. The balance of the total price of the Stay must be transferred to the Provider's account no later than 5 weeks before the start of the Stay.
The rates of stays are stated in the relevant currency, including the VAT, and include the services specified on the website www.yogaandhike.cz in the “Price includes” section. The prices of the stays do not include any insurance.
The Client is informed about the payment method when making the booking. The payment of the Stay means the Provider’s account crediting with the total price of the Stay.
The Client must pay for the Stay: in CZK by a bank transfer or by a cash deposit to the Provider's account: acc. no. 115-1010660277/0100 at Komerční banka, a.s. BENEFICIARY: Nix Terra, s.r.o., Špindlerův Mlýn 127, 543 51, CZ, ID No.: 04362314.
The Client's stay can be fully or partially paid by his/her employer, another organization respectively. In such case, the Client shall state this fact already when making the booking and the Stay shall be invoiced based on the booking to the ordering party in accordance with valid regulations.
If the price of the Stay is not paid in due time, no contractual obligation arises to the service Provider. The service Provider may withdraw from the Contract.
Issuance of any gift vouchers is subject to payment of 100% of the gift voucher price. Purchased gift vouchers are non-refundable. Gift vouchers are valid for the period specified on the voucher.

V. Withdrawal from Contract and Cancellation Conditions
a. Withdrawal from the Contract
The Client has the right to cancel the Stay, i.e. to withdraw from the concluded Contract, in accordance with the Cancellation Conditions. Such withdrawal by the Client (hereinafter referred to the “Cancellation”) must be done by e-mail or in writing and provably delivered to the Provider.
The Provider shall be entitled to receive a compensation fee (hereinafter referred to the “Cancellation Fee”) in the amount specified in the Contract. If a Contract is canceled, the Provider shall, within 14 days at the latest, account for and refund the paid price with the Cancellation Fees deducted.

b. Cancellation Conditions
In case of cancellation no later than two months before the scheduled start of the Stay, the Provider will charge the Cancellation Fee of 20% of the total price of the Stay.
In case of cancellation no later than one month before the scheduled start of the Stay, the Provider will charge the Cancellation Fee of 50% of the total price of the Stay.
In case of cancellation later than one month before the scheduled start of the Stay, the Provider will charge the Cancellation Fee of 100% of the total price of the Stay.
The total amount paid is 100% refundable only if the Stay will not be organized. The Stay will not be organized if the minimum capacity is not reached, i.e. 8 persons. If the Stay is not organized, the Provider will return the entire amount paid to the Client within 14 days of the Stay cancellation. The Provider will inform the registered clients about any cancellation by e-mail, at least one month before the scheduled start of the Stay.

VI. Confirmation of the Stay
The Client shall be entitled to enjoy the paid for services based on the Confirmation of the Stay issued by the service Provider, containing the following information: name and surname of the Client, the Stay dates, price and payment date. The Client is obliged to check the correctness of the stated data and to contact the Sales Department immediately if any discrepancy is found.


VII. Final Provisions
Participation is at your own risk.
By making the booking, the Client in accordance with the Act No. 101/2000 Coll., as amended, agrees with his/her personal data processing for the purposes of his/her Stay confirmation and offers sending. Commercial communication shall be sent to the Client by post or by electronic messages in accordance with the Act No. 480/2004 Coll., as amended. The Client may withdraw his/her consent at any time in writing.
The service Provider reserves the right to change the program depending on weather changes.
